Welcome to Atazz, a classifieds service that connects sellers and buyers. Throughout these Terms of Use, references to Atazz UK or other regional Atazz projects will be referred to as 'Atazz'. These Terms govern the relationship between ATAZZ.COM LTD ('Company', 'we') and the internet users who access Atazz ('users', 'you'). By using Atazz, you agree to comply with these Terms and our user data policy. If you do not agree with these terms, you must stop using Atazz.

1. What is Atazz

Atazz is an internet site accessible at uk.atazz.com (including all domain levels), through both full and mobile versions, as well as a mobile application. It is a collection of the Company's intellectual property objects and information (both administrative and user-generated content) contained within the information system ('Atazz'). Atazz serves as an electronic catalog of advertisements for goods, services, vacancies, resumes, and other offers (collectively referred to as 'goods') that users can offer and search for in order to conclude deals. The Company provides authorized users with the technical ability to post information on Atazz in the format of ads within the presented categories of goods. The Company provides all users (regardless of authorization) with the technical ability to search and view ads on Atazz for the purposes outlined in the Terms.

Atazz's automated algorithms process queries to provide relevant information in search results. However, the Company is not a participant, organizer of transactions, buyer, seller, employer, intermediary, agent, representative of any user, beneficiary, or other interested party in relation to transactions between users. Users use the information posted on Atazz to conclude transactions at their own risk without direct or indirect participation or control by the Company.

2. Registration with Atazz

You can register with Atazz using your email address or through your social network profile, as provided in the Atazz login form. After registration, we will create a unique profile for you on Atazz, which can only be linked to one email box at a time. If you choose to register with Atazz through a social network, certain functions may be limited for you. In order to access all of Atazz's features, we may ask you to provide additional information such as a phone number or email address. By registering with Atazz, you warrant that you have the necessary authority to enter into and comply with these Terms.

3. Entrance to Atazz

To log in to your Atazz profile, you can either use the email address associated with your profile or the social network account linked to your profile (your "login information"). If you choose to log in using your email address, you will need to enter your password. If you choose to log in using a social network, you will need to log in to the corresponding social network first. It is your responsibility to keep your Atazz login details confidential. If you suspect that someone has gained unauthorized access to your account, please notify us immediately. Any actions taken on Atazz by a person who is authorized to use your login details will be considered to have been taken by you, and you will be held responsible for those actions.

4. Information about users

The information you provide to the Company about yourself must be reliable, up-to-date, and must not violate the law or the rights of third parties. It is your responsibility to keep your Atazz profile updated as necessary. We may request documents or information to verify your identity or authorization. If you fail to provide them, we reserve the right to restrict access to your profile. We cannot guarantee the accuracy of all information provided by users on Atazz. Please exercise discretion when making deals. We do not disclose non-public information about users to third parties, except as required by law (such as at the request of government agencies) or in cases where you order a paid advertising campaign for your ad on our partner sites through Atazz services. However, we are not responsible for illegal actions by third parties in relation to information that you have posted publicly on Atazz. 5. User Content

User-generated content refers to text and images that Atazz users post in ads, public profiles, and reviews. The Company is not a distributor of user-generated content. You are the owner of all the information that you post on Atazz. You can create, modify, post, and remove content without our participation or consent. It is your responsibility to ensure that your User Content complies fully with the laws, Atazz Terms of Service, ad policies, profile requirements, and reviews. You warrant that your content does not infringe on the intellectual property rights of third parties. Atazz does not censor User Content. We take action on content based on requests from authorized persons in the manner prescribed by law. The purpose for which users post information on Atazz is to establish contact with a potential buyer who is interested in concluding a deal in relation to the product in the ad. It is prohibited to post deliberately false information in reviews, to leave any reviews to sellers on Atazz if you are not interested in concluding a deal on the ad. It is also unacceptable to leave "mutual reviews" or reviews for a fee that contribute to improving the seller's rating. Collecting, copying, using, and any other actions with respect to User Content for purposes not provided for by the Terms are prohibited. You cannot use users' phone numbers or other contact information for purposes not directly related to the purchase of goods from the user. Duplicates of customer posts may be deleted by the administrator. If your published post has not been reviewed by any user for more than 90 days, your ad may be automatically deleted. You grant the Company the right to use your content and the intellectual property objects included in it under the terms of a non-exclusive license: indefinitely, without providing a fee, in any way, for worldwide action, with or without the name of the author. We may use your content to enforce the Terms, improve Atazz, for marketing purposes, in commercial and non-commercial projects (for example, in the Atazz auto catalog). We have the right to post user-generated content on other Internet resources and grant our partners rights to access it. We have the right to keep archived copies of user-generated content and not to remove materials that contain it from circulation.

6. Communication of users on Atazz

Authorized users can contact and send messages to each other through the Atazz website or application to discuss products and terms of the deal. It is strictly prohibited to use messages and calls for any purpose other than those specified in the Terms. Using messages and calls for purposes not provided for in the Terms violates the personal data protection law and causes losses to the Company. We reserve the right to record, analyze, and store all messages and forms of communication made through the Atazz website or mobile application. Please note that messages and contact forms of communication are not private. We may selectively review the correspondence and contact forms of communication to ensure compliance with the Atazz Terms of Use and improve our services.

7. Communication of Atazz with users

We may send you the following notifications:

● System notifications that cannot be unsubscribed from, such as confirmation of registration, information about access restrictions to your profile or ads;

● Service notifications related to your actions on Atazz, such as receiving a message from another user or personalized selections of interesting ads;

● Marketing notifications, including advice from Atazz, invitations to participate in research, promotions, and news from the Company, Atazz, and our partners.

We may send these notifications to the notification center in your profile, the email address or phone number specified in your profile, your device in the form of push notifications, and in messages to Atazz. In some cases, we may also contact you by phone (for example, to receive feedback and improve our services). You can manage some of these alerts and notifications in your profile settings. The settings may differ depending on your device.

8. Deleting a profile

You have the right to delete your Atazz profile at any time by contacting our support service or by doing it yourself. We reserve the right to delete your profile if it remains inactive for an extended period of time or for other valid reasons. After deleting your profile, you will not be able to use the phone number or email address associated with it for a new registration within 30 days.

9. Protection of intellectual rights

Atazz owns the exclusive rights to computer programs required for using its website, databases, graphic design of the interface, trade name, trademarks, logos, and other distinctive signs of the Company, including those used in the domain name Atazz.com.Atazz" and "Atazz UK," as well as the visual design, concept, and idea, are protected by intellectual property laws and belong to their creator, Evghenii Iacovet, the owner of ATAZZ.COM LTD. The Company uses them under an agreement with the creator. The Company has the rights to access registered and unregistered databases, including but not limited to Atazz ad database, Atazz vehicle ad database, Atazz user base, and other databases (collectively - "databases"). The databases include both advertisements posted in the public domain on Atazz and advertisements that are not available to users for viewing at some point. As the manufacturer of the databases, the Company incurs significant financial, material, organizational, and other costs for their creation. To protect the materials in its databases from unauthorized copying, the Company may automatically apply Atazz logos/watermarks or other text to the photos uploaded by users.

10. License to use databases and programs

We grant our users a non-exclusive license to use the databases and computer programs necessary to use Atazz, for the purposes outlined in our Terms of Use. This license is granted to you free of charge from the moment you access Atazz, and remains valid as long as you use our platform. You can search and view ads without registering or logging in, but you need to sign in to access other features of our website. Without our prior consent, it is strictly forbidden to use any technical means to interact with our service in ways that bypass our standard procedures for accessing our databases and computer programs. This includes using automated scripts or bots to collect information from Atazz. You may not use our databases and computer programs for any purposes not explicitly permitted by our Terms of Use. This means that you are not allowed to extract materials from our databases, or use them in any way, shape or form, unless it is directly related to a transaction involving goods or services advertised on our platform. For instance, you may not use our materials to populate third-party databases. You are also prohibited from using phone numbers obtained from our databases to contact Atazz users with unsolicited offers of services or goods.

11. Obligations of users

By using Atazz and interacting with the Company, you agree to:

strictly comply with all legal requirements;
adhere to the Atazz Terms of Service, ad posting policies, profile and review requirements, and other Atazz policies and Company guidelines;
refrain from contacting Atazz users if you are not a potential buyer and are not interested in concluding a deal on the ad, and from sending spam to users;
refrain from using obscene language, images, and statements that provoke violence, hatred or disrespectful attitude, contain threats or insults, justify illegal actions, or do not comply with moral norms or business practices;
refrain from using Atazz or information posted on Atazz for purposes not provided for by the Terms;
refrain from downloading or using malicious programs on Atazz;
avoid taking actions that may interfere with the normal operation of Atazz.

12. Violations and consequences

We strive to make Atazz a convenient and safe tool, and therefore reserve the right to randomly check users' compliance with the Atazz Terms of Use at any time and at our sole discretion. For this purpose, we may use automated methods. We have the right to take action if we have reason to believe that a violation of the law, the rights of third parties, or the Terms has occurred or may occur through the use of your profile or technical means. We have the right to restrict access to your profile or some functionality of Atazz, reject or block your content, and restrict access to Atazz from certain IP addresses, phone numbers, or email addresses. We may restrict access to the profile in the event of complaints from other users regarding such a profile, sending spam, repeated or malicious violations of the Terms of Use, hacking of the profile, failure of the user to provide documents or information at our request, termination of the user – a legal entity, or if we notice signs of fraudulent behavior on Atazz by the user, either in the presence of other similar circumstances or if the user has registered a new profile on Atazz instead of a previously blocked one. We have the right to restrict and restore access to the profile and determine the conditions for such restoration at our discretion and without giving reasons. We are not responsible for any possible losses, financial, moral, or otherwise, caused to users in connection with taking measures to prevent and stop violations on Atazz. We recommend that you keep a backup of your content on your device. If you violate the law or the rights of third parties when using Atazz, you may incur administrative, criminal, or civil liability.

13. Final provisions

The provisions of Sections 2, 3, 6-8 of these Terms apply to users registered with Atazz. All other provisions apply to all Atazz users, regardless of registration and authorization. Any form of interaction with Atazz, including viewing information, confirms your agreement with the Terms. The Company's obligation to provide access to Atazz functionality is contingent upon your obligation to comply with the Terms. When there is no charge for using Atazz, consumer protection law does not apply to the relationship between the Company and users. The provision of certain Atazz functionality may be subject to special terms. Atazz functionality may be changed, supplemented or discontinued at any time without prior notice to users. The use of Atazz is provided on an "as is" basis, which means that the Company provides Atazz functionality in the form and volume in which they are available at the time of access. We are not responsible for temporary disruptions and interruptions in the operation of Atazz or for the loss of information resulting from them. We are not liable for any indirect, incidental, or unintentional damage, including lost profits or data, damage to honor, dignity, or business reputation, resulting from the use of Atazz. Atazz UK is intended for users in England, and therefore some functionality may be limited or unavailable outside of England. Atazz is intended for worldwide users, but some functionality may be limited or unavailable in certain regions. Atazz may contain links to third-party sites. We do not control and are not responsible for the availability, content, or legality of such third-party sites. When resolving disputes between the Company and users, the legislation of the country where the Atazz company is registered applies. All disputes must be directed to a court of justice in accordance with the territorial jurisdiction at the location of the Company, unless otherwise provided by law. We update the Atazz Terms of Service as necessary. We recommend that you periodically visit the page on which they are posted. When using paid services on the website, the website commission will be 9% of the advertising amount before merchant commission. Prices for services and fees may be changed with or without notice, only by updating the information in the terms and conditions of the website. Requests for refunds for advertising that is already running are not possible. By continuing to use Atazz after the Terms have been changed, you agree to the changes made to them.
